DomainsEye.com services owned and operated by Guava Softs Pvt Ltd is provided to you as a user under the terms and conditions of this Terms of User Agreement (herein referred to as "TOA") and any other operating rules or policies that may be published by DomainsEye.com on the website from time to time.

All the terms set here are presented in English language and it is the sole responsibility of the user to understand these terms accurately in the language he understands. You must read, understand and agree with and accept all of the terms and conditions contained in this TOA, Disclaimer and Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you use services or register at DomainsEye.com.

f) That you will not use the Service to distribute or up load any virus, trojan horses or do anything else that might cause harm to the Service, DomainsEye.com systems or to other members' systems in any way.

Whatsoever the circumstances DomainsEye.com will not be liable in any way for any content, including but not limited to any omissions or errors in any content, or any loss or damage incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the service.

h) You agree to grant the rights to DomainsEye.com to reveal your identity (or any other related information collected on this service) if required by law or in case of any legal action or complaint arising from any situation caused by your use of this site.

i) In exercising this right, DomainsEye.com may ask you to provide any documentary or other form of evidence supporting the information you enter while registering your Domain Names or in support of your WhoIs information available on Internet. If you fail to produce such evidence, DomainsEye.com may, in its sole discretion, terminate your Membership without notice and delete your Domain Names from the Database.

j) You acknowledge and agree that if your account at DomainsEye.com is blocked, you may be prevented from accessing all the services available under DomainsEye.com. Further, you agree that you may not try to register under an anonymous name to get access to the site otherwise for any purpose whatsoever.

k)  You agree that you may not (and permit anyone else to) copy, modify or extract the source code of the service or any part thereof. You further agree that you may not indulge in any kind of process, which may be termed as work of Reverse Engineer unless this is expressly permitted or required by law  or unless you have been specifically told that you may do so by DomainsEye.com, in writing

l) You agree to use the services only for the purpose that are permitted by the aforesaid Terms and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction. Further you agree that you will be solely responsible for any breach of your obligations under the terms and for the consequence of any such breach, including any loss or damage, which DomainsEye.com may suffer as a result and that DomainsEye.com cannot be held responsible to you or to any third party.  

As a registered user you are responsible for maintaining the confidentiality of your account information  and for restricting access to your computer, and you agree to accept responsibility for all activities that occur due to your use or under your account.

The email used at the time of registration of Domain Names should exactly match the Email Id appearing in Domain Name's WhoIs Information on the Internet, else the registration would stand void ab initio.  

Unless otherwise stated, the copyright and all intellectual property rights in all material presented on the portal are the property of DomainsEye.com, its affiliates and associates and are protected under applicable Indian laws. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.

Without limiting the foregoing, copying or reproduction, for redistribution or other purpose, of the web site or any part thereof to any other server or location, including caching of any kind is expressly prohibited.

Unless you have been specifically permitted to do so or have a separate agreement with DomainsEye.com you agree that you will not use  any  trademark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.

Further you acknowledge and agree to unconditionally and irrevocably granting DomainsEye.com the license to display, use, distribute, adapt, modify, reproduce any Content (including but not limited to your contact details) you submit or make available on this site or its members, from time to time.  

You may provide links only to the homepage of this Web Site, provided

(a) You do not remove or obscure, by framing or otherwise, any portion of the homepage,

(b) You give Provider notice of such link by sending an e-mail to us and you discontinue providing links to this Web Site if requested by Provider.  

The Terms of User Agreement and the relationship between you and DomainsEye.com shall be governed by the laws of India. The Courts of law at Mumbai shall have exclusive jurisdiction over any disputes arising under this agreement or other related issue arising out of the use of this site or related services. The failure of DomainsEye.com to exercise or enforce any right or provision of the TOA shall not constitute a waiver of such right or provision.

If any provision of the TOA is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and agree that the other provisions of the TOA remain in full force and effect.

Member agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOA must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

The section titles in the TOA are for convenience only and have no legal or contractual effect. 

You agree that DomainsEye.com, in its sole discretion, may terminate your account or password or use of any or all of the services, for any reason, including, without limitation, for improper use of any service or if DomainsEye.com believe that you are not eligible to become a member or have violated or acted inconsistently with the letter or spirit of the TOA. DomainsEye.com may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice.  

You agree that any termination of your access to the Service under any provision of this TOA may be effected without prior notice, and acknowledge and agree that DomainsEye.com may immediately deactivate or delete your account and all related information and messages and other information relating to you and/or bar any further access to any Service or all of the services. Further, you agree that DomainsEye.com shall not be liable to you or any third-party for any termination of your access to the Service.

Further, at the time of registration of Domain Name, if you provide any information that is untrue, inaccurate, not current or incomplete or DomainsEye.com has a reasonable ground to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the TOA, DomainsEye.com has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

You may terminate your service at any point with or without cause by writing to DomainsEye.com. 

Member can obtain assistance with any technical difficulty that may arise in connection with Member's utilization of the Software or Services by requesting assistance via email to admin@DomainsEye.com. DomainsEye.com reserves the right to establish limitations on the extent of such support, and the hours at which it is available.

Member is responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for its access to and use of the Software and Services and Member shall be responsible for all charges related thereto.  

13. Entire AgreementThese TOA constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. The Agreement shall be governed by the Laws of India.
